MEDIATUS Mediation Process

Initial Enquiry

Connect with MEDIATUS by scheduling a 30 minute call to discuss what we offer in more detail. Not all mediation is the same.  Let us work with you to ensure that the process suits your matter. 

 

Other Party Consulted  

Given the challenge in agreeing on a mediator, you can pre-agree our appointment prior to any dispute or we offer to contact the other party to ascertain their view on jointly engaging MEDIATUS. Alternatively, you or your lawyer can liaise directly with the other party and we can provide our terms and conditions. Should everyone agree to proceed, all parties undergo a detailed assessment. 


Mediation Agreement 

Once everyone agrees to proceed with MEDIATUS, we provide a standard agreement along with an authority.  We ask you to complete an authority confirmation to ensure that the correct decision-makers are involved in the mediation process right from the start.   We may also obtain availability dates and any specific needs of the parties in advance.  


Detailed Assessment  

Conducting a detailed assessment enables MEDIATUS to effectively and efficiently gather all the information we require about your matter. It allows you to set out more than just the legal issues.  It is easy to complete but extensive and may reduce the extent of formal mediation papers and legal submissions.  It promotes transparency between you and MEDIATUS whilst maintaining confidentiality.    


Pre Intake Sessions - separately conducted

Once the detailed assessment occurs we meet one on one separately with the person granted authority. This individual intake session or pre mediation conference is allocated approximately 2 hours per party but can be tailored for each individual mediation. MEDIATUS seek to ensure similar time with each party during each individual intake session.  


Legal Intake Sessions

Additional legal intake sessions can be conducted directly between MEDIATUS and your lawyer if parties have instructed external legal firms.


Expert Engagement 

If agreed by all parties, MEDIATUS can provide options and engage an expert or industry specialist to support the mediation.  Associated costs will be quoted prior to engagement for approval by both parties.

 

MEDIATUS Mediation  

Instead of waiting for a court-appointed mediation or following a traditional legal dispute process, MEDIATUS offers a collaborative conflict resolution process with other specialists - including your lawyer, if you already have one.  At MEDIATUS we believe we can provide you the best chance of reaching agreement and resolving your conflict to your satisfaction.
